Terms & Conditions



This contract is between The T Barn (referred to as “TB”) and the relevant individual making the booking on behalf of their Group (referred to as “you” or “your”). You shall ensure that all members of your Group comply with these Terms & Conditions. All bookings made are subject to these Terms & Conditions. Your booking will be confirmed once the deposit or any payment required under these Terms & Conditions has been received by TB in cleared funds. Any booking constitutes acceptance of our Terms & Conditions. You must be 18 years of age or over at the time of making this booking.

 

1. Payment

Payment of the full balance of the total cost of your stay is due 42 days before the date on which it is to commence. For bookings made less than 42 days before arrival, the full booking amount will be requested immediately to secure the booking. If payment fails to reach TB in accordance with these Terms & Conditions, TB will notify you and you will have seven days to complete the payment. If full payment is not received within seven days of the date of notification, TB reserves the right to cancel the booking and in order to pay for administrative costs and to compensate TB, retain all deposits paid. All accommodation booked by you in these circumstances will immediately be publicly advertised as being available for re-hire.

 

2. Pre-authorisation charge - Security Deposit

We reserve the right to levy a pre-authorisation charge of up to £100 per hut on credit/debit cards. This pre-authorisation charge is in addition to the deposit. The pre-authorisation charge is required for the reimbursement to TB of any unusual costs which it may incur as a result of your stay, including without limitation: damage, breakages, exceptional cleaning costs, waste recycling sorting or delayed departure by you and housekeeper’s time reallocating items moved between tents. Guests should inform TB at the commencement of hire of any damage found on arrival. TB reserves the right to charge for any damage or missing items not reported by you on arrival. Should there be no reason for TB to retain the pre-authorised amount this will be released to you in full within 5 days of departure.

 

3. Cancellation By You


We understand that sometimes things don't go quite to plan, if you do need to cancel your stay below are our cancellation terms: 

If cancelled more than 8 weeks prior to your stay - you will receive a full credit note or refund for the amount you have paid.

If cancelled less than 8 weeks prior but more than 28 days prior to your stay - we can offer you a credit note to the value what you have paid for your stay OR 30% of your booking value will be retained.

If cancelled 28 days or less from your stay- 100% of your booking cost will be retained unless we are able to resell your dates, in which case we can offer you a full credit note. 

We reserve the right to refuse any booking or cancel any bookings subject to refunding any sums you have paid without further liability on our behalf.

We strongly advise guests to take out holiday cancellation insurance in advance of their trip.

DATE CHANGES

Where possible, we will try to help you change the date of your booking if you can no longer make it, however this is entirely at our discretion and if we cannot make a change, then the standard cancellation policy will apply. All date changes must be requested more than 8 weeks in advance of the original booking, otherwise standard cancellation policy will apply.

If we do manage to change you date and you change to another date for which a higher sum is charged, you will need to pay the difference at the time of change.

Any cancellation or change must be confirmed by email, by the person who made the booking.

No shows: You agree that if you have not arrived by 8am on the morning after your stay was due to commence, or contacted TB to confirm your arrival, your stay with us will be deemed to be cancelled and the total cost will be forfeited to TB.

4. Cancellation By Us


We cannot accept responsibility or pay any compensation where the provision of the holiday is prevented or affected by reason of circumstances that amount to “force majeure”. These include any event which we could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the property through fire, flood, explosion, storm or other weather damage, break-in, criminal damage, riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity, epidemic, pandemic and all similar situations beyond our control.

5. Termination of Stay

You are expected to maintain reasonable and appropriate standards of behaviour at all times whilst at The T Barn. TB have the right, at their sole discretion, to terminate your stay if you or members of your group are reasonably believed to be causing a nuisance to the other guests or are not treating the property with due respect. TB may require all or any such persons to leave the accommodation, without refund and in such an event, TB will not be liable for making any payment to you and in order to compensate TB for the nuisance caused will retain all monies paid by you.

6. Refusal of Entry

TB reserves the right to refuse entry to any or all guests within the party if these Terms & Conditions are not observed. Any function, celebration, party, corporate event or ceremony must have the written permission of TB. Any occupancy is for the purpose of a temporary holiday rental only and does not create the relationship of landlord and tenant between you and TB.

7. Care of the Property

During your stay you will take good care of your accommodation provided to you by TB. On your departure, you agree to (a) leave your accommodation in the same condition of cleanliness and tidiness as at the commencement of your hire; (b) to pay for any loss or damage caused by you, during your occupation. Any items moved from other tents must be returned to the appropriate tent prior to departure. Tents must be secured (zipped up, fires extinguished, all lights and water turned off) upon departure. TB reserves the right to charge you for any loss, damage or extra cleaning to our property during or after your stay. All decorations, must be removed and confetti must be biodegradable and used only outside. Waste recycling should be disposed in the correct bins.

8. Number of Persons using the Huts

There must be no more members in your group than the property is designed to accommodate which is two people.

9. Limitation of Liability

TB accepts responsibility for those arrangements that are within its control but cannot accept liability for any injury, illness, loss or damage suffered by you or any member of your party unless one of the following applies:

• There was fraud or wilful default by us or our employees, or

• Death or personal injury was caused by the negligence of TB or our employees.

Please notify any shortcomings, complaints or dangerous items and potential hazards to us immediately so that they can be remedied. Claims may be reduced or rejected if we have not been given the opportunity to put matters right or investigate them.

10. Arrival and departure times

The hire period commences at 4pm on the first day of hire and terminates at 11am on the last day of hire. Any significant delay in arrival should be notified to TB in order that arrangements can be made for entry into accommodation. Any significant delay in departure may incur a charge. Sunday departures may be extended with the agreement of TB.

11. No Smoking Policy

Smoking is not allowed inside any hut and TB reserves the right to charge for costs of cleaning and redecoration if this provision is breached. Smoking is however allowed in the outside areas.

12. Pets

No pets are allowed at The T Barn unless agreed by the owners and farmers, locally.

13. Right of Entry

For the undertaking of necessary repairs, maintenance and/or inspections, TB has the right of entry to the property at all reasonable times. Prior notice will be given to you wherever possible and privacy will be respected at all times. TB or their appointed representatives reserves the right to carry out viewings at the property during the guest’s stay. At least 6 hours notice will be given to the guest wherever possible and disturbance will be kept to a minimum.

14. Hot Tub and Associated Facilities

You should take all reasonable care and obey the hot tub rules displayed in the welcome pack. You are responsible for your own safety whilst using the hot tub as it is unsupervised. No lifeguard is in attendance. Children under the age of 16 years and those people of any age who cannot swim must be supervised. Only paying guests of TB are allowed to use the hot tubs unless prior permission is given by TB.

15. Complaints

TB want you to have an enjoyable stay. In the event of any problem arising on arrival or during your holiday, you should immediately bring this to the attention of TB or its representative and TB shall, at all times, endeavour to deal with any complaint or query promptly. TB regrets that claims for compensation cannot be considered after the holiday has ended if there was no such prior notification.

16. Lost Property

TB or its representatives will retain lost property items at their office premises for 28 days from the date of your departure. For items to be returned, TB reserves the right to charge a flat administration fee of £10.00 plus postage and packaging, payment for which is required in advance. TB does not accept responsibility for returning any items and will not return any food or drink left at The T Barn.

17. Delay or Failure to Perform

TB will not be liable to you if we are prevented or delayed in performing any of our obligations to you if this is due to any cause beyond TB’s reasonable control including (without limitation): an act of God, explosion, severe weather, flood, fire or accident; malicious damage; outbreak of disease; any form of government intervention or a third party act or omission.

18. Changing these Terms & Conditions

TB reserves the right to revise and amend these Terms & Conditions from time to time. You will be subject to the most recent Terms & Conditions in force at the time that you make your booking, unless any change is required to be made by law or if we notify you of the change to these Terms & Conditions before we confirm that your booking has been successful.

19. Data Protection

TB will only store and use the information you supply to us for the purposes of carrying out our contract with you, to collect valuable feedback about how satisfied you were with the services provided and from time to time to send information regarding special offers and promotions at The T Barn. 20. Third Party Rights

These Terms & Conditions are made for the benefit of you and TB and is not intended to benefit any third party or be enforceable by any third party. The rights of you and TB to terminate, rescind, or agree any amendment, waiver, variation or settlement under or relating to these Terms & Conditions are not subject to the consent of any third party.

21. Governing Law

These Terms & Conditions are governed by the law of England and Wales, and any dispute arising out of or in connection with these Terms & Conditions is subject to the exclusive jurisdiction of the courts of England and Wales.

22. Catering provided

All food delivered by The T Barn can be kept cool in the fridge box throughout your stay.  If you would rather use your own means of refrigeration, please feel free to do so.

The temperature of the food will be taken on delivery. Once delivered it is your responsibility to ensure the necessary precautions are taken to keep your food items cold. If you believe there is a problem with the items on delivery, notify The T Barn immediately.

If you fail to follow this advice and you believe the quality/temperature of the food has been compromised, do not consume.
